DeenTab – Terms of Service

Welcome to DeenTab! These Terms of Service ("Terms") govern your access to and use of the DeenTab website, application, and all associated services, features, and content (collectively, the "Service"). The Service is provided by DeenTab ("we", "us", or "our").

By accessing or using the Service, you signify that you have read, understood, and agree to be bound by these Terms, whether or not you are a registered user of our Service. If you do not agree with any part of these Terms, you may not access or use the Service.

1. Your Acceptance

By using the Service, you agree to these Terms. You also acknowledge that you have read and understood our Privacy Policy, located at https://active.deentab.app/privacy-policy, which explains how we collect, use, and share your personal information.

2. Eligibility and User Accounts

• Age: You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or legal guardian's permission to use the Service.
• Account Creation: To access certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Account Responsibility: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use, or suspected unauthorized use of your account.
• No Sharing: You may not share your account or password with any other person.

3. The Service

DeenTab is a productivity and Islamic companion application designed to help users manage tasks, access Islamic content (such as Quran, Nasheeds, Prayer Times), organize notes, track time, and enhance focus through features like the Pomodoro timer. We strive to provide a serene and productive environment for our users.

• Changes to Service: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) with or without notice at any time. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
• Availability: We will use reasonable efforts to make the Service available, but we do not guarantee continuous or uninterrupted availability.
• Third-Party Content: The Service may include or link to third-party content (e.g., external images, videos, audio streams, APIs for prayer times). We are not responsible for the accuracy, legality, or appropriateness of such third-party content.

4. User Conduct

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe upon the rights of others, including intellectual property rights.
• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Engage in any form of "spamming" or unsolicited advertising.
• Attempt to interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks connected to the Service.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Use the Service for any commercial purpose without our express written consent.

5. Premium Services and Billing

• Subscription: DeenTab offers various premium features and content through paid subscriptions ("Premium Services"). By subscribing to Premium Services, you agree to pay the specified fees.
• Billing: You will be billed on a recurring basis (e.g., monthly or annually) as per your selected plan. Payments are processed through third-party payment providers (e.g., Lemon Squeezy, or manual payment gateways as specified). You agree to provide valid and current payment information.
• Automatic Renewal: Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew, and you authorize us (or our third-party payment processor) to charge the applicable subscription fee for the next billing period.
• Cancellation: You may cancel your Premium Service subscription at any time through your account settings or by contacting our support. Cancellations will take effect at the end of your current billing period. No refunds will be provided for any unused portion of a subscription period.
• Price Changes: We reserve the right to change our subscription fees at any time. We will provide you with reasonable prior notice of any price changes. If you do not agree with the new price, you may cancel your subscription before the new price takes effect.
• Manual Payments: If you choose a manual payment method, your Premium Service will be activated upon our confirmation of your payment. It is your responsibility to provide accurate payment details (e.g., transaction ID, phone number) for verification. Delays or failures in providing correct information may result in activation delays. Manual payments typically do not auto-renew and require re-initiation upon expiration.

6. Data Collection, Processing, and Privacy

We are committed to protecting your privacy and ensuring transparency about our data practices. We collect and process data strictly for the purpose of providing and improving the DeenTab Service. Our data collection is limited to what is necessary for functionality and user experience.

• Types of Data Collected: This may include account information (email, name), usage data (how you interact with the Service), and content you create (tasks, notes, calendar events). For payment processing, we rely on secure third-party providers who handle your payment details; we do not store sensitive financial information directly.
• Purpose of Processing: Data is used to:
  • Provide, maintain, and improve the Service's features and functionality.
  • Personalize your experience.
  • Process transactions and manage subscriptions.
  • Communicate with you regarding service updates or support.
  • Analyze usage patterns to enhance performance and user satisfaction.
• Data Security: We implement robust security measures to protect your data from unauthorized access, alteration, disclosure, or destruction.
• No Data Selling: We DO NOT sell, rent, or trade your personal data to any third parties for their marketing purposes.
• Data Sharing: We may share data with trusted third-party service providers (e.g., cloud hosting, analytics) only to the extent necessary to operate and improve the Service, and only under strict confidentiality agreements. We may also disclose information if required by law or to protect our rights.
• Data Retention: We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements.

7. Intellectual Property

• Our Content: All content on the Service, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is our property or the property of our licensors and is protected by copyright and other intellectual property laws.
• Your Content: You retain all ownership rights to any content you create or upload on the Service (e.g., notes, tasks). By posting or uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with the operation of the Service.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or follow the account deletion process in your settings.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
